Decision In Favor Of Warehouse Worker

December 12, 2017By Niko Pothitakis

Austin, a 22-year old Iowa worker, was employed by Dr. Pepper as a warehouse loader. During his work at Dr. Pepper, he injured both shoulders in 2015 and 2016 and received treatment from an authorized doctor.  His doctor also recommended a psychological referral for work-related stress, but no action was taken by the employer or the insurance company to ensure that Austin would get an appointment for his mental health issue. Austin continued to have pain associated with his work injuries. His doctor made a referral to a pain management specialist, but the specialist refused his case.  Austin and his attorneys filed a case against Dr. Pepper in order to get him the additional medical care he needed. The hearing resulted in that Austin was granted the right to choose his own mental health provider within 14 days.  Furthermore, the hearing ordered Dr. Pepper to authorized pain management treatment for their employee.
